EPA, Army Move Toward Proposal to Revise WOTUS Definition

WASHINGTON, D.C. — The EPA and U.S. Army recently concluded a series of listening sessions to gather input on the definition of “waters of the United States” (WOTUS), a key term guiding Clean Water Act enforcement. Stakeholders—including farmers, developers, tribes, and environmental groups—voiced concerns over regulatory uncertainty, urging clarity and consistency. 

The sessions were part of the agencies’ response to the Supreme Court’s Sackett v. EPA ruling, which invalidated the Biden Administration’s 2023 WOTUS definition. EPA Administrator Lee Zeldin emphasized the need for clear rules that protect water and support economic growth. 

A proposed revised rule is expected later this year, with a final version targeted by the end of 2025.
